40 to testify against Westgate suspects
Prosecution has lined up 40 witnesses to testify against four suspects facing charges in connection to the Westgate mall terror attack.
The suspects, Mohammed Ahmed Abdi, Liban Abdullah, Adan Adan and Hussein Hassan, are accused of supporting the terrorist cell that staged the September 21 attack in the upmarket shopping mall.
Other charges against them include entering Kenya illegally and obtaining false identification documents.
Somali militant group Al Shabaab claimed responsibility for the attack that killed 67 people.
On Monday, the suspects appeared before Nairobi Chief Magistrate Kiarie Waweru but were remanded until Tuesday when their lawyers will ask the court to release them released on bond.
Prosecution counsel Warui Mungai opposed the release of the suspects on bail, arguing they a flight risk and their nationalities have not been determined.
The defence lawyers applied to be supplied with all affidavits filed by the police opposing the release of the accused on bond.
Harbouring terrorists
According to the prosecution, before the day of the attack, Mohamed Ahmed Abdi and Liban Abdullah supported two terrorists identified as Moahmmed Abdinur Said and Hassan Mohammed Dhohullow in “committing a terrorist act at the Westgate Mall.”
Mr Adan is also accused of offering shelter to one Abdikadir Hared Mohammed alias Mohammed Hussein at a location along Eastleigh’s Muyuyu Avenue in Nairobi.
The offence is alleged to have been committed on or before October 7 at Salman Al Faris Madrassa.
He allegedly harboured Mr Mohammed alias Moahhmed Hussein who he knew had committed a terrorist act.
Another suspect Adan Dheq, was further charged with obtaining a false Kenyan identity card on July 13, 2010 at the National Registration Bureau office in Mandera town.
The four suspects deny all the charges against them and the case has been fixed for hearing on December 19.
