Ex-street boy who sneaked into KDF camp asks court to give him employment

A former street boy who, is also an orphan, has pleaded with the Judiciary to employ him because he does not want to return to the streets.

Brian Mulima Andika pleaded with Senior Principal Magistrate, Ms Mugure Peter, to come to his aide by assisting him to get a job in the judiciary.

Andika, 18, told the court that he had been pushed into street life after his parents died, living him at the mercy of unkind relatives and a harsh society.

Andika, who pleaded guilty to a charge of entering a Kenya Defence Forces camp, which is a protected area, told the court that he entered the prohibited area to seek employment knowing he could have lost his life.

FIRST OFFENDER

The accused also narrated how he was being supported by a Good Samaritan until he completed his primary school education.

“I attained good marks in Standard Eight then I joined Form One but I could not proceed for lack of school fees,” Andika told the court.

“I have not lost hope because God is able and one day I will meet a Good Samaritan, just like your honour, and he will volunteer to get me employment or take me back to school to pursue my education,” he told the court.

Andika asked the magistrate to pardon him and spare him a custodial sentence. State prosecutor, Ms Ann Pertet, also asked the court to treat the accused as a first offender.

NONE CUSTODIAL SENTENCE

Ms Pertet said the accused was investigated by the Ant-Terrorism Police Unit (ATPU) and found to be innocent.

The magistrate however ruled that the accused be interviewed by the probation department with a view to giving him a none custodial sentence.

“This court has considered your mitigation and would like the probation department to interview you and see how better you can be assisted,” Ms Mugure ruled.

She directed the accused to be remanded in custody until March 7, 2017 when a probation report will be availed.

The accused had pleaded guilty to entering Embakasi Field Intelligence Battalion Camp without permission on February 27.
