Moses Kuria risks arrest as DPP moves to cancel bail
By KENFREY KIBERENGELoose-tongued Gatundu MP Moses Kuria could soon be cool his heels in police cells if a request by the director of public prosecutions (DPP) to cancel his cash bail is granted by the courts.
Mr Keriako Tobiko, the DPP, has filed an urgent application in court for the cancellation of the Sh2 million cash bail that was granted to Mr Kuria in the existing case where he is accused of insulting a certain community on social media.
“I wish to confirm that I have already directed that an application under certificate of urgency be filed in court for cancellation of the bail granted to Moses Kuria in the case already in court,” says Mr Tobiko.
The DPP also wants fresh charges instituted against the controversial lawmaker, who was recently caught on tape urging some of his constituents to hack opponents of the revamped National Youth Services programmes with machetes.
“Further, I have called for the file relating to the latest utterances for purposes of deciding on separate criminal charges to be instituted against Hon. Kuria,” says the DPP in a letter to the National Cohesion and Integration Commission chairman Francis ole Kaparo, which is copied to Director of criminal investigations Ndegwa Muhoro and Mr Hassan Mohammed, NCIC secretary.
This is the second time NCIC and the DPP are pushing for the cancellation of Mr Kuria’s Sh2 million bail.
Similar attempts failed last April after the two offices alleged that he had reneged on an agreed deal for him to stop inciting the public using social media.
But Senior Principal Magistrate Enock Cherono dismissed the application, saying there were no compelling reasons for the cancellation. She said the bail could only be cancelled if the accused skips court sessions.
