Nairobi businessman in court for damaging brother’s car, assaulting neighbour

A man who allegedly poured a corrosive substance on his young brother’s car and later smashed the closed circuit television (CCTV) cameras at the compound in Kasarani,  a Nairobi suburb, has been charged with maliciously damaging property worth more than Sh550,000.

David Irura is accused of willfully and unlawfully destroying his brother Karuga Ngatia’s car worth Sh522,000 on July 27, 2023, in contravention of section 339 (1) of the Penal Code.

He is also accused of destroying Sh30,000 worth of CCTV cameras at Mr Ngatia’s compound on August 16, 2023.

Mr Irura is also accused of assault and causing actual bodily harm to his neighbor Jimmy Muiruri in contravention of section 251 of the Penal Code where he is accused of beating up the complainant on September 3, 2023.

He is accused of committing the offences in the Queen Apostle area in Kasarani where he resides in the same neighbourhood with the complainants.

Mr Ngatia woke up on the material day only to find his car having been smeared with an unknown substance on various parts that were corroded by the substance.

He reviewed the CCTV footage and the accused person, who is his elder brother, was allegedly captured in the video splashing the substance on the car.

Mr Ngatia reported the matter at the Kasarani police station and the police recovered the video which has been taken to the Directorate of Criminal Investigations (DCI) headquarters for preparation to be used as evidence in the case. The damage caused to the car is estimated to be worth Sh522, 000.

On August 16, while police were still investigating the case of damage to his car, Mr Ngatia returned home to find his CCTV cameras having been vandalized.

He established that his elder brother had been captured by the cameras before he destroyed them with a wooden piece and reported the same to the police.

Mr Muiruri on the other hand was leaving for church when Mr Irura’s sons who were riding a bicycle blocked his car and the accused person allegedly assaulted him after he engaged them to unblock the exit. He reported the matter to the police before seeking treatment.

Mr Irura was later arrested after investigations into the matters were concluded.

He denied the charges before Principal Magistrate Irene Gichobi of the Makadara Law Courts and sought lenient bail and bond terms through lawyer Paul Khadondi.

Ms Gichobi said that a pre-bail report is necessary to guide the court on setting bail and bond terms owing to the relationship between the parties.

Mr Irura will be remanded for seven days for the Probation and Aftercare Services department to carry out the social inquiry.

The matter will be mentioned on October 17 when the report will be tabled in court before the bail and bond terms are granted.
