Commission to kick private developer out of city land


The National Land Commission (NLC) will revoke a title deed belonging to a private developer who has erected a perimeter wall around a facility that is said to belong to the Nairobi Water and Sewerage Company.

The developer, who has been identified, is said to have ignored several warnings from both the county government and the anti-corruption agency to stop the illegal construction at the site.

NLC vice-chairperson Abigael Mbagaya Mukolwe said the commission would repossess the land.

“This is a very serious issue. The said person has not even bothered to appear before the commission to clarify certain issues despite several attempts to get him.

‘‘We have now served him. We will however proceed and make a determination on the land which clearly belongs to the public,” Ms Mukolwe said.

The said private developer has already brought down a wall put up by the Nairobi County government and erected his around the facility despite a court ruling barring him from the same.

According to the Ethics and Anti-Corruption Commission detectives, the developer started construction by ignoring warnings from the urban planning directorate and the court.

“We urge people to do proper due diligence on parcels they intend to buy. Whether you have a title or not, a public land can never become a private utility because the government need such parcels for expansion of infrastructure for the benefit of citizens,” Ms Mukolwe said.

The parcel is guarded by several young men who have clear instructions not to allow anyone inside.

Last month EACC CEO Halakhe Waqo wrote to Nairobi Governor Evans Kidero asking for his intervention to stop the said illegal construction at the site and help protect the reservoir.
