Court hands DJ Brownskin temporary freedom
Michael Macharia, popularly known as DJ Brownskin, who is facing charges of aiding his wife Sharon Njeri to commit suicide has been freed on a cash bail of Sh100,000.
Brownskin was released by Milimani Chief Magistrate Lucas Onyina who explained the pre-bail report presented before him by the probation department was favourable.
In his ruling Onyina said relatives of the accused person and those of the deceased spoke ‘well about him’.
“I find the pre-bail report tabled in court favors the accused persons herein by confirming that he is well known and has a fixed abode known by state agencies. This to me confirms the accused is not a flight risk and l will grant him bond in accordance with the law,” Onyina ruled.
The court concurred with defence lawyer Dunan Okatch that no compelling reasons were advanced by the prosecution to warrant the court decline the bail plea by the accused who has been in custody for 14 days.
“Having analyzed the pre-bail report and considering all the submission by Okatch and state prosecutor Anderson Gikunda, I find no cogent reasons to warrant the accused be denied bond/bail,” Onyina ruled.
He went on to grant the accused bond of Sh200,000 with an alternative cash bail of Sh100,000.
Upon granting DJ brownskin bond, Okatch urged the court to direct that a cash bail of Sh50,000 deposited at the Makadara Law Courts when he was presented there in a miscellaneous be transferred to the criminal case so that he pays the difference of Sh50,000.
But Oyina declined to grant the request by asking the lawyer to pursue the said money in the Makadara Law Courts differently.
DJ brown who had been in custody for 14 days was charged on with three charges of aiding suicide, neglect to prevent a felony and destroying evidence by deleting the videos he had uploaded in his social media of the videos regarding the suicidal incident of his wife Sharon Njeri at their house in July 2022.
He was arrested in May 2023 after a video surfaced a month earlier showing him appearing to record his wife taking poison.
When he was charged, Onyina ordered the DJ to be remanded in custody to await a pre-bail report.
The case will be mentioned after a fortnight to set a hearing date.
