Court summons woman whose husband sold off house


A woman whose husband sold off their matrimonial house in Buruburu without her knowledge has now been ordered to appear in court for contempt.

Mrs Beatrice Imbweya Alumasi failed to comply with a court order directing her to allow the new buyers of the house to start collecting rent from the servant quarters.

Mr Charles Ngirubiu and Mrs Esther Waithera Karanja had bought the house from her husband, Mr Gerald Alumasi.

Land and Environment Court Judge John Mutungi had allowed an application by the purchasers of the home to start collecting rent from the servant quarters pending determination of the case to enable them service a mortgage loan.

“The illegal rent collection continued while my husband and I are the ones suffering losses by paying mortgage loan for a property which we do not occupy or collect rental income,” said Mrs Waithera in her court papers.

Mrs Alumasi wants the court to cancel the sale and order her husband to refund the money to the buyers because the house in dispute is a matrimonial home and was sold without her consent.
