DPP withdraws Sh19 million corruption case against Aisha Jumwa

The Office of Director of Public Prosecution (DPP) has withdrawn a corruption case against former Malindi Member of Parliament Ms Aisha Jumwa.

Ms Jumwa who was recently nominated to be the Cabinet Secretary for the Ministry of Public Service was facing charges of conspiring to commit fraud.

She is accused of making illegal payments of Sh19 million through the Constituency Development Fund (CDF) without following the protocol. Her charges were withdrawn under section 87 (a) of the Criminal Procedure Code (CPC).

Senior State Counsel Alex Akula who represented the prosecution team told the Mombasa chief magistrate Martha Mutuku that he was under instructions to apply for the withdrawal of charges for the first accused person namely Jumwa.

“I have instructions to move the court with an application on review of charges and that is specified on the first accused person the final directive is to have her name removed and the case against eight suspects who had been charged alongside Jumwa to proceed,” Mr Akula said.

The defence team also accepted the move to withdraw the charges as it asked the prosecution team to ensure that they apologise for charging the political leader and portraying her as corrupt.

“We welcome the kind gesture from the DPP, we have no objection against the withdrawal however we wish he would offer an apology to our client,” Ms Jumwa’s Lawyer Jared Magolo said.

On Friday, October 7, 2022, Ms Jumwa was supposed to be arraigned in court over the same case but she never turned up.

In the same week, Ms Jumwa who contested for the Kilifi County governorship seat failed to turn up in court to answer charges linked to the case.

Her lawyer told the court that Ms Jumwa had fallen ill after failing to win the Kilifi governorship race and doctors had advised her to take bed rest.

The lawyer produced a medical document in court indicating that Ms Jumwa was ill.
