Man who defiled daughter jailed for 15 years

An elderly HIV-positive man has been imprisoned for 15 years at the Kodiaga GK Prison for defiling his 17-year-old daughter at Tido Kasule area in Kisumu County.

The accused man, 60, was found guilty of incest and defilement by Kisumu Senior Resident Magistrate Benard Kasavuli.

The prosecution told the court that Chokwe had been sexually molesting the minor since 2007 after his wife passed on.

The accused faced three counts of touching the minor’s private parts, having carnal knowledge of the girl against natural justice and displaying pornographic materials to her with the intention of luring her into the sexual act.

The minor was the first to testify against the culprit way back in 2011 when she informed the court that she lived with Chokwe alongside her younger brother in the family’s two-roomed house at Tido, where he committed the offense on various occasions.

SEXUALLY ABUSED

In 2011, the minor summoned enough courage to reveal the sexual abuse to her stepmother who was also tormented by the gory disclosure.

She reported the matter to the police and Chokwe was arrested and charged with the offense.

George Mwita, a clinical officer at Kisumu county hospital, told the court that after cross-examining the girl, he established that she had been sexually abused.

However, Mwita disclosed that further medical tests confirmed that the minor was HIV negative.

In his brief defense, the man denied ever having defiled the daughter and blamed his tribulations on the woman he married after the first wife died. He was given 14 days to appeal the sentence.
