Kayole welder battling defilement charges
A welder has been charged with defiling a 14-year-old girl contrary to section 8 (1) of the Sexual Offences Act of 2006.
Mr. Omar Asman Malala is accused of defiling N.A.M on diverse dates between July 1, 2023, and August 18, 2023 at his house in Kayole, a Nairobi suburb.
He is facing an alternative charge of committing an indecent act with a minor where he is accused of unlawfully and intentionally touching her genitals during the same period at the same place.
The suspect was arrested by the members of the public after the minor who had disappeared from her parents’ house at night to sleep with Mr Malala led them to his house on August 19, 2023.
She is reported to have spent the night with Mr Malala at his house.
The minor told police she had been communicating with Mr Malala on phone until at around 11pm on August 18, 2023, she sneaked out of her parent’s house while her mother was asleep and went to meet the accused person at an agreed point.
The accused person is then said to have carried the minor on his motorbike and took her to his house where the girl spent the night.
She left at around 9am and started loitering in the area until around 4pm when she met some of her neighbours who were helping her parents look for her.
The neighbours took her to the nearby chief’s office where her parents were summoned.
They informed the administrator they had already reported the matter at the Kayole police station.
She led her relatives and neighbours to Mr Malala’s house where he was arrested and frogmarched to Kayole police station. The minor was taken to the Mama Lucy Kibaki Hospital where she was examined and found to be pregnant.
The two are said to have commenced their relationship when Mr Malala lived near the minor’s parents before he moved houses.
Mr Malala denied the charges when he was arraigned before Senior Principal Magistrate Gerald Mutiso of the Makadara Law Courts. He was released on a bond of Sh300, 000.
The case will be mentioned on September 11, 2023, for a pretrial.
