Man accused of conning businessman Sh4 million


A man who is reported to have conned a businessman of Sh4 million while promising him a lucrative business deal has been charged with obtaining money by false pretenses.

Stephen Mutisya Nzioka is accused of obtaining the cash from Josphat Munyua Warui on diverse dates between February 1, 2013, and May 10 this year in Kamae, within Kasarani sub-county in Nairobi.

Nzioka is accused of committing the offense jointly with his accomplice who is at large while purporting he could trade in a treasure box a fact he knew to be false.

He was also charged with conspiracy to defraud contrary to section 317 of the penal code.

He is accused of conspiring with his accomplice Thomas Muia to defraud Mr. Warui of the cash promising they could sell him a treasure box from Germany, a fact he knew to be untrue.

Mr. Nzioka is also facing an additional charge of possession of narcotic drugs after he was allegedly found with three rolls of bhang worth Sh300 during the time of his arrest at Oldonyo Sabuk trading centre in Machakos County.

He is accused of storing the bhang in contravention of the Narcotic Drugs and Psychotropic Substances Act of 1994.

Mr. Warui was reportedly duped after being told the accused person and his accomplices would introduce him to the business of buying an old valuable “treasure box” which he would sell and make millions in profits.

He started sending cash to Nzioka and othersvia mobile money and bank transfers of different amounts at different times.

The complainant later realized that he was being conned after the two failed to deliver anything to him.

He reported the matter to the police and Nzioka was traced using his mobile phone numbers and was arrested.

The accused person denied the charges before Senior Principal Magistrate Mary Njagi of Makadara Law Courts. He was released on a bond of Sh2.5 million.

The matter will be mentioned on December 6 this year before hearing starts on March 21st next year.
