Man caught vandalizing Kenya Defence Forces fence at Embakasi Garrison charged with theft


A man allegedly arrested while vandalizing the Kenya Defence Forces’ (KDF) Embakasi Garrison fence was charged at the Makadara Law Courts with theft contrary to section 268 (1) of the penal code.

Peter Omwange was charged with stealing three rolls of chain link valued at Sh18000 belonging to the KDF on April 13, 2023.

He allegedly committed the offence jointly with others who fled during the arrest.

He is facing an alternative charge of handling suspected stolen property after he was allegedly arrested with the three rolls of the chain link used for fencing.

Mr Omwange was arrested by a KDF officer who found him and the others allegedly cutting and removing the wire using pliers.

They had already loaded the three rolls on a hand cart belonging to Mr Omwange.

The officer who arrested the suspect also recovered a pair of pliers that was being used by the suspects.

The military officer is listed as a witness in the case. Mr. Omwange could not escape and leave the hand cart behind so he was cornered and arrested.

During investigations, the accused person told the police that he had been called by five people known to him who hired him to transport the said chain link for them but they fled the scene when the KDF officer on patrol appeared.

Mr Omwange denied the charges before Senior Principal Magistrate Mary Njagi and claimed that his hand cart got lost during the arrest.

He said a police officer had promised to avail it to him but he is yet to see it.

He was released on a cash bail of Sh20, 000.

The case will be mentioned on May 19, 2023, before hearing starts on September 4 this year.

Mr Omwange was charged a few months after another man pleaded guilty to charges of stealing a general-purpose machine gun mounting stand from the heavily protected military establishment.

Macdonald Wanjohi admitted that he stole the stand and a Land Cruiser door belonging to the KDF all valued at Sh56,000, at the garrison on November 8 last year contrary to Section 268 as read with Section 275 of the Penal Code.
