Man in court for threatening to beat up mother


A man who allegedly threatened to beat up his mother before smashing 29 pieces of window glasses valued at Sh10, 000 at her house was charged with malicious damage to property contrary to section 339 (1) of the penal code.

John Mburu, 36, was accused of willfully and unlawfully destroying the windows belonging to his mother namely Hannah Njeri at Mwiki Township area in Kasarani within Nairobi after she declined to open the house for him on the night of April 15, 2023.

He is also facing a separate charge of creating a disturbance in a manner likely to cause a breach of peace contrary to section 95 )1) (b) of the penal code where he is accused of hurling insults at Ms Njeri on the same night.

He is said to have hurled unprintable insults at her.

Court heard that Ms Njeri was asleep when she heard her son knocking on her door while making noise after presumably returning home drunk at around 2am.

She did not open the door.

The suspect started throwing tantrums and allegedly destroyed the windows with his walking stick while demanding to be let in to sleep.

Ms Njeri later reported the matter to the police and the suspect was traced and arrested.

He denied the charges before Senior Principal Magistrate Mary Njagi of the Makadara Law Courts and claimed to have lost his crutches at the Kasarani police station.

The suspect was released on a cash bail of Sh30, 000. The case will be mentioned on April 19, 2023, when the officer investigating the matter will respond to Mr Mburu’s claims that he lost his crutches while in custody.

Ms Njeri and her daughter are listed as witnesses against Mr Mburu.

Mr Mburu was charged barely a week after another man was charged with threatening to kill his mother.

Franseo Mwenda, 37, was charged with issuing death threats to his mother on April 5 at her house in Kasarani. Mr Mwenda denied the charges and is out on bond awaiting trial to start.
