Man who impregnated 16-year-old sister-in-law charged with defilement

A 24-year-old man who allegedly impregnated his 16-year-old sister-in-law has been charged with defilement contrary to section 8 (1) (4) of the Sexual Offences Act of 2006.

The accused was arraigned at the Kibera Law Courts on charges of defiling the minor at his house in Kileleshwa, Nairobi on diverse dates between April 15 and September 6, 2022.

The accuse is also facing an alternative charge of committing an indecent act with the minor in his house during the same period.

The matter was reported at Kileleshwa Police Station by the man’s wife who informed the police that that her husband has been defiling her sister in their house.

The minor, who is a Form One student in Trans Nzoia County, had visited her sister during the March- April school holidays after completing her Kenya Certificate of Primary Education (KCPE) examinations.

It was reported that during the minor’s stay, her sister’s husband expressed interest in her and allegedly started seducing her. The suspect is said to have defiled the minor while her sister was away at their rural home.

The minor later travelled upcountry where she joined a secondary school but later went for a pregnancy test where it was established that she was nearly two months pregnant.

The minor is reported to have called and informed the accused that she was pregnant. Her mother later noticed that the minor had symptoms of pregnancy and confronted her. The minor admitted that she was indeed pregnant and shared details of how she had been defiled by her brother-in-law.

The family was torn between procuring an abortion and letting the minor carry the pregnancy to term. With the matter still unresolved, the minor sneaked out and travelled to Nairobi to live with a friend in Kangemi. She later met the accused who took her to his house.

The suspect was arrested by the police and charged with the offence of defilement. He denied the charges before Principal Magistrate Monica Maroro and was granted a bond of Sh500,000. The matter will be mentioned on September 22 for pre-trial and fixing of hearing dates.
