Prosecution given 120 days to complete Gilbert Deya’s case
The High Court has given the prosecution 120 days to complete its case against controversial televangelist Gilbert Deya or else he will be granted bail.
This came after the High Court on Tuesday upheld the decision by a magistrate’s court to deny bail to Deya, after his lawyer John Swaka had appealed the decision by chief magistrate Francis Andayi.
Justice Luka Kimaru said the reasons given by the prosecution to oppose the bond application were compelling enough.
CHILD THEFT
The preacher, who was extradited from Britain in August and charged with child theft, had applied to be released on bail.
Deya’s case was mentioned on August 25 and hearing was set for September. He has denied five counts of stealing children.
Prosecution was told to supply the defense counsel with witness statements and documentary evidence.
Through his lawyer, the preacher had earlier decried the poor conditions at Kamiti Maximum Prison when he appeared in court.
He said the conditions in the room where he was being held is pathetic and not fit for human habitat.
Mr Swaka said Britain and Kenya agreed that the preacher be accorded VIP treatment but that was not happening.
USE A BUCKET
He said Mr Deya was not allowed to leave his room from 7pm, “and because there are no washrooms, he has to use a bucket and keep it in his room till morning”.
Deya is remanded at the Kamiti Maximum Security Prison, pending trial.
He has been charged that between 2002 and 2004 on Mountain View Estate, Nairobi, Deya stole children all under the age of 14.
The case will be heard on October 9 and 16.
