Rape suspect released on Sh1 million cash bail

A South Sudanese charged with defiling a five-year-old has been released on a Sh1 million cash bail.

Senior Principal Magistrate Timothy Okello at the Makadara Law Courts granted Madhak Deer was granted the cash bail with two sureties of similar amount after prosecution failed to provide grounds in their opposition to his bail terms.

State Prosecutor Jacinta Nyamosi asked the court last week to deny the suspect bond terms stating that he was a foreigner and thus a flight risk if given bond.

She told the court that the accused was facing a serious offence and should be be denied bail since he may jump bail and abscond court.

RIGHT TO APPEAL

Representing the accused lawyer Charles Koech opposed the application and said that the accused is entitled to bond constitutionally.

Okello dismissed the application by the prosecution and said they have a right to appeal his ruling.

He ordered that the accused deposits his passport and any other travelling documents before court.

Madhak is facing charges of defiling a five year girl on March 3 at Nyayo estate in Embakasi. The case will be heard on March 31.
