Safaricom executive seeks to stop case on causing pedestrian’s death


A Safaricom director has moved to court seeking to stop her arrest and prosecution in relation to an accident she caused leading to the death of a girl.

This follows a letter by Director of Public Prosecutions Keriako Tobiko on October 19, directing the prosecution of the company’s Consumer Business Unit director Sylvia Mulinge for causing the death of an eight-year-old girl by dangerous driving in 2015.

Ms Mulinge is expected to present herself at the Kibera Law Courts on Monday.

However, she has opposed her prosecution, asking the court to prohibit Mr Tobiko, the Inspector-General of Police and the chief magistrate of the court from taking any steps which would result in her arrest and prosecution, arguing it would prejudice her rights.

Ms Mulinge further wants a declaration that the DPP, in directing the police to arrest and charge her with the offence when the police had already filed a report exonerating her, has abrogated her right to equality and freedom from discrimination and amounted to unfair administrative action.

“The applicant went to Lang’ata police station on the same day and reported the accident and the following day recorded a statement,” her lawyer said in court papers.
