Sh25m award for Waititu kin? Not just yet…


A relative of former Embakasi MP Ferdinand Waititu will have to wait longer for the court to decide whether he will bag Sh25 million earlier awarded to him.

Mr Nicholas Mbugua Wainaina had sued Mr Waititu’s family claiming they short-changed him in the sharing of proceeds from the sale of  a piece of land.

The former MP’s wife Susan Wangari Ndungu, daughter Monica Njeri Ndungu and Bins Management Services — where the two women were directors — were named as the defendants.

When they failed to respond to the suit, the court granted Mr Waititu’s uncle’s plea — directing them to pay him Sh25 million plus interest.

Mr Mbugua then engaged an auctioneer to attach property and recover the amount, but the defendants in the earlier suit went to court saying they were not heard and wanted the orders set aside.

Way forward

High Court Judge Jonathan Havelock on Wednesday said he would rule on the way forward.

Sometime in 2012, Mr Waititu approached his two uncles; Messrs Mbugua and William Kagotho Gachuiri informing them that through Bins Management Services, he had negotiated a purchase offer from the National Bank of Kenya for their jointly-owned piece of land in Saika. Mr Mbugua was not happy with the way the money from the sale was shared.
