Simmers owner to stay as court awaits response


A city restaurant owner will stay at his business premises on Kenyatta Avenue following extension of orders barring two companies from evicting him.

Simmers Restaurant owner, Mr Suleiman Murunga, had the orders against Nilestar Holdings ltd and Green Valley Ltd extended pending an inter partes hearing on Wednesday.

Justice John Mutungi directed the petitioner to file written submissions within 14 days, while the respondent was given a similar time frame to respond.

The respondents allegedly purported to seize Mr Murunga’s goods on December 17 last year to recover alleged rent arrears amounting to Sh1.6 million.

But Mr Murunga said he had been a tenant of Nilestar Holdings Ltd whose 99 years leasehold term expired and had not been renewed or extended.

He claimed that the landlord-tenant relationship between him and Nilestar holdings expired on or about December 31, 2009 when the company’s (Nilestar holdings ltd) interest in the property ended.
