Sonko to deposit security
Nairobi Senator Gidion Mike Mbuvi Sonko has been directed to deposit security in court as a condition for stopping construction on disputed land.
Justice Pauline Nyamweya said the senator will have to deposit the security in order to move the court to grant the orders he is seeking.
The direction followed an application by Tranquillity Development Limited through lawyer Andrew Khakula.
He argued that the orders would prejudice the developer who used approximately Sh300 million in the construction works and engaged contractors paid per hour.
Registered trustees
The senator filed the application early this year to protest eviction of more than 20,000 jua kali artisans from the land in Buruburu, after the National Council of Churches of Kenya (NCCK) sold it to Tranquillity.
Mr Mbuvi through his lawyer Atkins Ambani argued that in 1983, the government had issued a grant to registered trustees of NCCK for the piece of land but with special conditions that it would be used for a project that would benefit the community through construction of light industrial facilities.
This was to apply to NCCK and any subsequent owner of the property but which is not the current position as he is putting up godowns on the land.
