Supreme Court to remain open until midnight Friday


The Supreme Court registry will open from 7am up to midnight Friday to give ample time for the filing of presidential election petitions.

A notice issued by the Registrar of the Supreme Court, Esther Nyaiyaki, said similar accommodation will be given to President Uhuru Kenyatta’s team to respond to the petition or petitions.

According to the Presidential Election Petition rules, the petitioner is required to serve the respondent within two days of filing; the respondent, on the other hand, must file the response within four days of being served.

The Registry will open until midnight on the fourth day to receive the response.

The Registry has been opening between 7 am and 8 pm from August 14  to the 17th.

“These working hours will be subject to such other directions as the Chief Justice may issue,” said Ms Nyaiyaki.

Article 140 (2) of the Constitution provides strict time frames within which petitions filed in the Supreme Court should be heard and determined.

Interlocutory applications must be filed one day from the date of filing of the response, while the pre-trial conference will take place eight days after filing the petition.

The hearing will take place immediately after the pre-trial conference.

The Constitution requires that the Supreme Court makes the determination within 14 days of the filing of the petition, in this case on or before September 1.
