Trader wants church to pay Pastor Ng’ang’a’s Sh2m debt


A trader who sued a city pastor over a three-year-old debt wants the money held in the church’s bank accounts used to settle the amount.

Mr Geoffrey Kimani Ndung’u claimed that the cash saved in Neno Evangelism Centre’s two bank accounts, which the court has twice frozen, should be released to him to settle the Sh2,179,495 owed to him by Pastor James Maina Ng’ang’a.

Mr Ndung’u first moved to court in January, seeking orders for the preacher to pay him back or the debt be recovered from trustees of the church’s accounts.

FREEZE ACCOUNTS

In April, the High Court issued the first order freezing the accounts at Cooperative and Equity banks.

However, despite the order, the trader returned to court, with Senior Principal Magistrate Linus Kassan issuing an order on August 4, similar to the earlier one.

Mr Ndung’u’s demands come after Cooperative Bank Ukulima branch manager Susan Miriti disclosed that the church’s account had insufficient funds to settle the debt.

But the complainant argued that the monies in the accounts should be released to him.

He accused the pastor of moving the funds from his (Ndung’u) account to an account belonging to the church in April 2012. Mr Ndung’u said he was of unsound mind at the time.

The preacher denied the claims through his lawyer Assa Nyakundi. He said if money was deposited in the church account, it was done so without coercion or inducement, hence an absolute gift.

The case will be heard on October 28.
