Trattoria seeks contempt proceedings against landlady
A city restaurant has moved to court seeking orders to commence contempt proceedings against the owner of the building that houses it.
Trattoria restaurant is also seeking an order for accessibility to some areas of the building, Town House, to enable it to reconnect its storage water tanks, pending hearing and determination of their application.
According to the suit papers, the restaurant wants Ms Joaninah Wanjiku, the landlady it has sued, held for allegedly ignoring a court order.
The hotel also seeks to commit for contempt Gerald Maina, Grace Maina and Daniel Maina, whom it has listed as directors of Gatma Investments limited.
The restaurant claims an order of permanent injunction by the court should restrain Ms Wanjiku from doing any acts contrary to its quite possession and enjoyment of the premises.
“The applicant continues to suffer damage to its property and colossal losses to its businesses as a direct consequence of the respondent’s unlawful actions,” part of the application read.
During the mention of the case, the court heard that the respondent was vandalizing the property and the applicant was unable to operate its business.
The respondent was not ready to proceed with the matter and sought some time to file their suit papers.
