Two jailed 13 years for forcing a woman to drink own urine

A Kabarnet court on Thursday sentenced two middle aged men to 13 years imprisonment after they were found guilty of assaulting and forcing a woman to drink her own urine.

Josephat Chesire and Kipkorir Kiptui were found guilty of assaulting Sote Selina and causing bodily injuries on 27th June 2015 at Tenges in Baringo County after claiming that she was a witch.

The prosecution succeeded in proving a tight case against the first accused Josphat Chesire who was said to have molested and assaulted the complainant while the second accused insulted, molested and stripped the complainant contrary to section 215A of the penal code.

BEATING AND STRIPPING HER

During the hearing, Selina narrated how the two went to her house and started beating and stripping her claiming she had bewitched their mother and that she should ensure she gets well.

“They forced me to urinate and drink my own urine as a proof that I was not involved in their mother’s sickness adding that I will die after drinking my urine if I was guilty,” said Sote.

Passing the judgement, Kabarnet Principal Magistrate Mr Samson Temu said that after going through a report from the correctional officer, he found that the act was a result of retrogressive behaviour in the society and meted the harsh punishment to deter others from doing the same.

“It might be true that the two accused were angered by the conditions of their sick mother who they alleged was bewitched, but that does not allow them to take illegal actions against their perceived witch. It is against the law,” said Temu.

STILL IN PAIN

The principal magistrate added that the probation officer said that the complainant was still in pain and has declined to forgive the two offenders.

“Beating her up will attract a sentence of three years and for undressing and forcing her to drink her urine, you will be jailed for 10 years,” pronounced the magistrate saying the sentences would run concurrently.

The accused were also informed of their right to appeal within a fortnight.
