Two men charged with homosexuality

Two men were arraigned before a Kwale Court accused committing an unnatural sexual offense contrary to section 163A of the penal code caption 63.

George Maina Njeri and Caleb Omar Iddris appeared before Kwale Resident Magistrate Christine Njagi on Friday for the offence.

The court heard that on February 18, 2015 at Tandoori area in Ukunda township, the two men were found “practising and having carnal knowledge against the order of nature”.

George Mungai, a prosecutor, said police officers were still conducting investigations to establish the truth of the matter.

Mr Mungai said preliminary investigations showed that there might be foreigners and locals involved in the issue, and asked the court to grant him three more days to complete the investigations. The two suspects were remanded in Diani police station.

MEDICAL EXAMINATION

The prosecution submitted to the court that the two suspects should be taken to Msambweni District Hospital for medical examination.

The defendants’ lawyer David Omuya told the court that he was ready for any charge against them and that on Monday next week he will apply for the release of the two on bond.

Omuya also told the court that the accused persons have been undergoing harassment from the police officers hence and asked the magistrate to compel the police to stop the harassment.

Ms Njagi ordered the two suspects be detained at Diani Police Station for investigations to be completed and the medical examination conducted. The accused persons will appear in court on February 24 this year to take their plea.
