Babu Owino’s rival moves to court to challenge expulsion
Eight University of Nairobi students have moved to court to challenge their expulsion following last month’s protests over disputed student union elections.
The eight include Michael Jacobs Odhiambo, the arch-rival of newly elected Students Organisation of Nairobi University (Sonu) president, Babu Owino.
Others in the suit are Harold Mugozi, Elwak Benedict, Mark Ojwang, Anthony Otieno, Raymond Bramuel, Paul Ayanga and Arthur Oriwo.
They have sued the Attorney General and the University and are seeking a suspension of their expulsion.
They argued in their court papers on Tuesday that the decision was unfair since no closed circuit television (CCTV) camera footage was presented before the Senate disciplinary committee that showed the exact group of students who destroyed property.
They claim that the decision was an abuse of power,unjustifiable and beyond rules of natural justice.
They further claim they were not given opportunity to defend themselves adequately.
Earlier, Michael Jacobs was released on a free bond by Magistrate Charity Oluoch at the request of the Director of Public Prosecution (DPP).
Mr Jacobs, who was arrested on Monday, was due to face arson and destruction of property charges at the Milimani Law Courts.
He had spent Monday night at the Central Police station over accusations of torching Sonu offices during last month’s protests.
