Waititu battles to retain water board job

Former Embakasi MP Ferdinand Waititu has filed an urgent application to save his appointment as chairman of the Athi Water Services Board.

Mr Waititu is seeking to have orders restraining him from assuming office lifted, claiming that the petitioner— Mr Benson Riitho— misrepresented facts to obtain them.

The petition leading to the orders, he argued, was filed in bad faith and non-disclosure of the fact that he had already assumed office.

“The petitioner failed to inform the court that I had already taken over soon after the gazette notice of my appointment, and that none of the prayers he is seeking is enough to make the court lock me out of office,” he said on Monday.

He swore that the issues of personal integrity alleged by Mr Riitho were false and out of proportion since he had never been found guilty of murder or incitement to violence.

The petitioner accused the former lawmaker of inciting Embakasi residents to oppose evictions, propagating hatred against Maasai community and grabbing land in Embakasi.

“The implications of the allegations imply that I am a murderer and someone who condones violence. Such allegations are defamatory and should have not formed the basis by which the orders were issued,” swore Mr Waititu.

Lady Justice Mumbi Ngugi certified the application as urgent and scheduled the hearing for Wednesday.
