Ban on PSV night travel lifted


Owners of long distance public service vehicles are free to consider re-introducing night travel from tomorrow (Thursday) after the High Court lifted a five month ban.

The 60-day ban, which was earlier issued by High Court Judge George Odunga, has been lifted after the cabinet secretary for transport and infrastructure, and the National Transport and Authority Board failed to give reasons why the orders should remain in force.

The government was expected to give court reasons why the orders should be enforced and/or file an application seeking for the orders to be extended.

The matatu operators had filed a case challenging the enforcement of the night travel ban arguing that the regulations were not properly introduced.

Judge Odunga found that the regulation requiring compliance to the new night travel laws were indeed invalid but granted the 60 days ban to allow the government to make the laws legal.

He had at the same time ruled that the existing public service vehicle owners’ licences, which had been canceled by the National Transport and Safety Authority, are still valid and that the fine imposed on public service vehicle owners for contravening the new laws are invalid.
