Court restrains Cyprian Nyakundi from discussing Governor Fernandes Barasa


Judge Rawlings Musiega of the Milimani Commercial Magistrate Court has restrained controversial blogger Cyprian Nyakundi from tweeting, posting, speaking or writing about Kakamega Governor Fernandes Barasa in relation to a case involving the governor.

In an injunction issued by Justice Musiega, Mr Nyakundi, Rashid Echesa and two others were restrained from republishing, continuing to publish or further disseminating any information about the alleged extortion being faced by Governor Barasa.

“That the application be served on the respondents for inter partes hearing on the 8th day of April 2024, given under my hand and seal of the Honourable Court this 25th day of March 2024,” the court order concluded.

The order stems from a case in which Governor Barasa was extorted to Sh240 million by a man, Mr William Simiyu Matere alias Elijah, who threatened to leak private information about the governor if the money was not given to him.

The matter landed in court last week at the Kibera Magistrate’s Court. Mr Matere denied two counts of conspiracy to commit an offence contrary to section 393 of the Penal Code and demanding property by threat contrary to section 302 of the Penal Code between December 2023 and March 18, 2024.

The magistrate granted the accused bail in the sum of KSh2 million with a surety in the same sum.

The order against Nyakundi stated that he had commented on the matter on his X handle on March 20, 2024 and March 21, 2024.
