Woman charged with committing fraud at Makadara Law Courts


A woman who allegedly defrauded a businessman of Sh85, 000 at the Makadara Law Courts is facing charges of obtaining money by false pretenses contrary to section 313 of the Penal Code.

Ms Nancy Wambui is accused of obtaining the money from Simon Gitundu inside the court on diverse dates between June 12-20, 2023, while falsely pretending she was in a position to secure a surety for his wife Margaret Njeri to be released on bond.

Ms Njeri had been charged with obtaining money by false pretenses vide Criminal case number MCCR 3566/2023.

Ms Wambui is accused of colluding with others in the alleged fraud.

She is also facing a second charge of conspiracy to commit a felony where she is accused of colluding with others during the same period to carry out the alleged fraud in contravention of section 393 of the Penal Code.

Ms Wambui was arrested at the court on July 31, 2023, alongside four others including Ms Njeri after Chief Magistrate Francis Kyambia suspected they were involved in fraudulent activities.

Others arrested alongside Ms Wambui are Molo based pastor Joseph Waweru and Ruiru businessman Stephen Mburu who were allegedly found with release orders for Ms Njeri’s accomplice Daniel Mucheru.

The Directorate of Criminal Investigations (DCI) investigated the matter and established that Ms Wambui had allegedly conned Mr Gitundu and had received the cash via M-pesa on different dates.

Ms Wambui had earlier been banned from setting foot at the Makadara Law Courts by Justice Heston Nyaga of Nakuru High Court who was then in charge of the court.

The accused person is said to have duped the complainant that she could get sureties to secure bond for his wife who was at the time remanded at the Langata Women’s Prison after denying fraud charges.

Ms Wambui was arrested after spotted by Ms Njeri in the court. The rest were released after they were cleared of any wrongdoing during the investigations.

She denied the charges before Senior Resident Magistrate Mercy Malingu and pleaded for lenient bail and bond terms claiming she is elderly and has a family solely depending on her.

The accused person was released on a bond of Sh200, 000 with alternative cash bail of Sh50, 000. Mr Gi Gitundu and Ms Njeri are listed as witnesses in the case against Ms Wambui.

The case will come up for a mention on September 9, 2023, before hearing starts on December 5, 2023.
