Case on Mutoko’s house robbery fails to start
A case against two night guards charged with violently robbing radio personality Carolyn Mutoko failed to start on Thursday.
The prosecutor told the court that Ms Mutoko, who is the main witness in the case, had travelled out of the country on official duties.
Defence lawyers opposed the application for adjournment saying there is no document presented to court to show that the witness was out of the country.
Nairobi acting chief magistrate Daniel Ochenja allowed the application for adjournment by the prosecution and directed the case to be heard on May 5.
The accused Mr Paul Yungo and Daniel Nduru also faced an alternative charge of failing to prevent the robbery against Ms Mutoko.
The guards were also charged with violently robbing Ms Christine Khaendi two mobile phones valued at Sh6, 000.
They denied the charges and were each released on a Sh500, 000 bond with a surety of similar amount.
The two allegedly jointly with others not before court while armed with an AK47 rifle, a pistol and crude weapons robbed Ms Mutoko of her Ipads,mac book, five wrist watches, assorted earrings and necklaces and phones.
The accused, who are guards at Rosslyn garden, were arrested for failing to prevent a robbery despite knowing that persons intended to commit the act.
According to the prosecution, the accused committed the offence on January 14 this year at Rosslyn Gardens estate, Nairobi.

The presenter was attacked at her home by a gang of seven. She reported the matter at Nyari police station .
