A Nairobi night guard who stole assorted liquor brands valued at  Sh750,000 from his employer on Christmas Eve has been sentenced to serve a year in jail.

Mr Jackson Moseti declined to mitigate after he pleaded guilty of the offence and was handed the sentence before principal magistrate Peter Ndwiga on Monday at the Milimani law court, Nairobi.

His suspected accomplice, Mr John Theuri denied the charge and was granted a cash bail of Sh 100,000.

Prosecutor Brigit Kanyahi told the courtthat the two were employees at Hope Wines and Spirits and  worked as guard and caretaker, respectively.

“On the night of December 24, the complainant left her shop securely locked in the presence of the caretaker only to receive a call later that the premise had been broken into and her property stolen,” the prosecutor said.

She said the complainant identified as Sarah Waithera Njuguna had also left the night guard watching over the premise at Midtown Plaza on Taveta Road.

“The guard disappeared after the incident but was later traced and charged,” Ms Kanyahi said. Shealso  said that a report of the incident was made at Central Police Station.

“A critical look at the scene of crime revealed that whatever went on should have attracted the attention of the guard raising suspicions was that he was involved,” the prosecutor added.

She said to date, the stolen property is yet to be recovered but asked the court to treat Mr Moseti as a first offender as he does not have a criminal record..

Before the sentence was pronounced, the magistrate had asked the suspect to mitigate but he declined by shaking his head.

He was sentenced to serve a year in jail.

The second suspect in the case was ordered to get copies of witness statements in preparation for a hearing on February 10 2014.
