Visually impaired man slapped with 30-year jail term for defiling
A 20-year-old school cook who is visually impaired has been sentenced to serve a jail term of 30 years after he pleaded guilty of defiling a pupil aged five years.
Eliakim Kemboi alias Elias surprised an Eldoret court when he confessed to have defiled the minor in a class at a school where the accused has been working as a cook together with the mother of the victim.
While pleading guilty, the accused claimed that he had already removed the minor’s pants when her mother found him at the scene.
He however claimed he was yet to engage in the act when the minor’s mother arrived at the scene.
The charge sheet stated that the accused defiled the minor inside a classroom at a private school in Moiben Sub County on August 29, 2023.
He was also charged with an alternative charge of having indecent act with a minor contrary to the sexual offences act of 2006.
The minor’s statement in court confirmed that she was defiled by the accused who was well known to her.
“He called me into the class and removed my stocking before putting me on the teachers table after unzipping his trouser and did ….” the minor’s statement in court revealed.
In his own confession the accused claimed that although he had removed the minor’s underwear, he did not do anything to the complainant.
“I had removed her underwear and when her mother came in shouting I left the classroom after she refused to listen to me so that we can talk about the issue,” the accused told the court in his statement.
The accused was later arrested by police officers from Ainabtich police station.
He was arrested the following day at Mti Moja area in Eldoret town where he had fled to after the incident was reported at Ainaptich police station.
Medical examination report from Moi Teaching and Referral Hospital indicated that the minor was defiled.
While delivering her ruling Eldoret Principal Magistrate Caroline Wattimah observed that even if the accused claimed that he had not defiled the minor when her mother came in, his action of undressing the minor’s under wears was a clear indication that he had a wrong motive.
The court observed that the accused was well known to the complainant and did a heinous act to the minor whom he was supposed to protect.
“Your action and your own pleading have confirmed that you are not a good person and more so, to the minor who knew you. This court has sentenced to serve a jail term of 30 years,” ruled the Magistrate.
The accused has 14 days to appeal the sentence.
