A boda boda rider who threatened to kill his estranged wife and children following a domestic dispute is awaiting sentencing after pleading guilty to charges of issuing death threats.

Mr John Kibe admitted that he has severally threatened to kill his wife and children. He told Principal Magistrate Hellen Okwani at the Kibera Law Courts in Nairobi that the matter arises from a dispute over a parcel of land in Kenol township in Muranga County and another in Kangundo in Machakos County.

He was charged with threatening to kill contrary to section 223 (1) of the penal code after issuing death threats to his wife Beatrice Wanjiku Ndung’u.

In the message, he threatened to kill his wife and their children before committing suicide if she does not give him the two parcels of land and Sh100,000.

Mr Kibe sent the message to his wife through his brother-in-law, Josphat Ngarau Ndungu’s phone on February 10.

The court heard that the two have been married for 17 years and have two children together in their matrimonial union that started having difficulties last year following accusations of infidelity.

He started issuing verbal threats to his wife and she moved out of his house in Mukuru kwa Reuben slums and rented hers in the same neighbourhood. The convict went on issuing the death threats.

The convict told the court that his wife told him that he has no share in the two parcels of land they own and she has turned down his plans to build a home in Kilimambongo where his mother gave him land.

The accused was convicted on his own plea of guilty. He maintained his plea of guilty despite a warning that the offence attracts a jail term of 10 years.

Ms Okwani remanded Mr Kibe in custody and ordered for a probation officer’s report. The social inquiry report will be tabled in court on February 28th before he is sentenced.
