Man charged with theft after withdrawing cash from girlfriend’s bank account


A man who transferred Sh100,000 from his girlfriend’s bank account to his M-Pesa account has been charged with theft. Kelvin Kamau has been charged with stealing the money from Jackline Ndunge on January 1 and 2, 2023 in Mwiki, Nairobi contrary to section 268 (1) as read with section 275 of the penal code.

Mr Kamau is accused of stealing the money by transferring the cash from Kenya Commercial Bank (KCB) account in two phases to his M-Pesa account.

Mr Kamau is accused of fraudulently transferring Sh60,000 on January 1, 2023 and additional Sh40,000 from Ms Ndunge’s KCB account on January 2, 2023. The complainant was at her rented house where she stays with Mr Kamau.

The accused person allegedly transferred the cash to himself without Ms Ndunge’s knowledge and consent. The accused person had earlier captured Ms Ndunge’s PIN number while she was doing transactions.

Ms Ndunge reported the matter to the police on January 10, 2023 after realizing the transactions had been carried out. Mr Kamau and his parents pleaded with Ms Ndunge to allow him repay the cash and they agreed on a date when he would make full refund.

He however did not pay as agreed and he sought additional time after which he still did not make the payments.

Mr Kamau denied the charges before Principal Magistrate Hellen Okwani of the Makadara Law Courts. Through his lawyer, Mr Kamau told the court he and the complainant are husband and wife and reconciliation efforts are in progress.

Prosecution counsel Jaqueline Omol opposed bail and bond terms for the accused person. Ms Omol told the court that Mr Kamau had earlier been charged at the court but vanished after he was released on bail.

Mr Kamau was remanded with the court ordering a pre bail report to be tabled before the magistrate considers releasing the accused on bail. The case will be mentioned on March 31, 2023 when the social inquiry report will be tabled in court.
