Court bars newly elected Chamber of Commerce officials from assuming office


The Commercial Court in Nairobi has issued an order barring the newly elected officials of the Kenya National Chamber of Commerce and Industry (KNCCI) from assuming office.

The court’s order comes after reviewing the application filed by applicant, Mr Hassan Wario. The applicant had sued the independent electoral board of the chamber chairperson, claiming that the elections were marred with irregularities.

“The injunction explicitly prohibits the third defendant, as well as their agents, employees, servants, or any other individuals acting on their behalf, from dealing with, filing, registering, presenting for registration, or applying for registration based on the returns filed by the first defendant,” the court order reads in part.

Dr Eric Rutto and Mr Mustapha Ramadhan were president and vice president of the Chambers during an exercise that was conducted on June 8, 2023. Dr Rutto garnered 291 votes against 208 votes for the outgoing president Richard Ngatia.

The court order has temporarily stopped the two leaders from assuming their offices, awaiting further directions.

The court further directed that the application be served to the parties and asked to respond within 14 days, awaiting its determination set for July 3rd.

Until his election as President, Dr Rutto served as vice president to Mr Ngatia.

During the announcement of results, Mr Ngatia accepted the outcome and thanked the members for the last four years that he served as President.

During last year’s General Election, Mr Ngatia had expressed interest in the Nairobi governorship seat. He later shelved his ambition and continued serving as Chamber’s president.
