Minor remanded after being arrested while attempting to rob city motorist

A minor who was arrested by police officers in Shauri Moyo, Nairobi after allegedly attempting to rob a motorist has been remanded after denying the charges in court.

The prosecution said the minor, aged 17, was arrested along Lamu Road on June 27, 2023 after he was found armed with a penknife in circumstances that suggested he was so armed with an intent to commit a felony.

The minor who had allegedly blocked a motorist while armed with the knife was arrested by two police officers who were on routine patrol in the area. He was then placed in custody at Shauri Moyo Police Station.

The suspect told the police that he and other youths had been ferried to the area from Kibera slums in a vehicle to attend a political rally at Kamukunji grounds last Tuesday. He confessed that he intended to snatch the motorist’s phone before he was nabbed by the officers.

The motorist neither stopped nor reported the incident to the police, therefore police could not charge the suspect with any other offence other than being armed with intent to commit a felony contrary to section 308 (3) of the penal code.

The suspect denied the charges after he was arraigned before Senior Principal Magistrate Gerald Mutiso of the Makadara Law Courts. He told the court that he is 17 years old and that he had dropped out of school after losing his parents.

Mr Mutiso remanded the suspect at Shauri Moyo Police Station and ordered for an age assessment to ascertain his age. The case will be mentioned on July 24, 2023 when the age assessment report will be presented in court.

The two police officers who arrested the minor alongside the investigating officer have been listed as witnesses in the case.
